Recent national discussions about educator-to-child ratios and supervision in early childhood education have prompted questions from families across Australia. You may have seen articles or government announcements about practices sometimes referred to as “under the roof” ratios and the steps Education Ministers are taking to strengthen supervision rules.

In Australian law, the paramountcy principle means that the safety, wellbeing and best interests of children must be the primary consideration in any decision affecting them.
This principle has long been embedded in the Family Law Act 1975, and more recently it has been reinforced within the early childhood education and care regulatory framework.
In practice, this means that when decisions are made about children’s care, safety, learning environments or supervision, children’s wellbeing must always take priority over convenience, cost or operational efficiency.
While this principle is now being more clearly articulated across the sector, it is not new to Mother Duck.
A Longstanding Commitment to Children First

- The Managing Director, a qualified Early Childhood Teacher with more than 30 years’ experience in the sector
- The Founder and Chairperson, who has dedicated more than 35 years to building high-quality early learning environments for children
Each service has a vote, and decisions are made collectively. This structure ensures that those with direct experience working with children and families are at the centre of decision-making.
These meetings are where the paramountcy principle is put into practice — with children’s safety, wellbeing and development guiding every discussion.
What Does This Mean for Ratios and Supervision?
Australian regulations set minimum educator-to-child ratios for early childhood services. These ratios ensure that enough qualified educators are present to support children’s safety and learning.
Recent reviews by the Australian Children’s Education and Care Quality Authority (ACECQA) identified that a small number of providers have used loopholes in legislation to technically meet ratio requirements while reducing active supervision of children.
Education Ministers have announced their intention to close these loopholes so that the law more clearly reflects the expectation of adequate supervision at all times.
